Florida law allows Finalization to occur after 90 days of Post Placement Supervision has taken place. However, this assumes all other requirements have been satisfied by that time. In order for an adoption to be Finalized, Birth Parents parental rights must first have been terminated. The Petition for Adoption cannot be set for final hearing until 30 days after entry of the Final Judgment Terminating Parental Rights. Best case scenario, Finalization can occur within 90 days of the child being placed in the Adoptive Parents home, but delays can occur if Birth Parents (usually father) do not cooperate, or if there is a wait for a hearing date because of the court docket.
